Repeal of gay ban blocked

GOP unanimously stalls defense bill

Senate Republicans yesterday blocked an effort by Democrats and the White House to lift the ban on gays from serving openly in the military, voting unanimously against advancing a major defense policy bill that included the provision.

The mostly partisan vote dealt a major blow to gay rights groups who saw the legislation as their best hope, at least in the short term, for repeal of the 17-year-old law known as "don't ask, don't tell."

If Democrats lose seats in the upcoming congressional elections this fall, as many expect, repealing the ban could prove even more difficult - if not impossible - next year. The Senate could take up the measure again during a lame-duck session after the elections, but a spokesman for Senate Majority Leader Harry Reid said he hasn't decided whether to do so.

"The whole thing is a political train wreck," said Richard Socarides, a White House adviser on gay rights during the Clinton administration.

Democrats included the repeal provision in a $726 billion defense policy bill, which authorizes a pay raise for the troops among other popular programs. In a deal brokered with the White House, the measure would have overturned the 1993 law banning openly gay service only after a Pentagon review and certification from the president that lifting the ban wouldn't hurt troop morale.

But with little time left for debate before the November ballot, the bill had languished on the Senate calendar until gay rights groups, backed by pop star Lady Gaga, began an aggressive push to turn it into an election issue.

Earlier this month a federal judge in Los Angeles declared the ban an unconstitutional violation of the due process and free speech rights of gays and lesbians. The decision was the third federal court ruling since July to assert that statutory limits on the rights of gays and lesbians were unconstitutional.

Reid agreed to force a vote on the bill this week and limit debate, despite Republican objections. A Nevada Democrat in a tight race of his own this fall, he also pledged to use the defense bill as a vehicle for an immigration proposal that would enable young people to qualify for U.S. citizenship if they joined the military.

Republicans alleged that Reid was using the defense bill to score political points with the Democratic base.

"This is not a serious exercise. It's a show," said Senate GOP leader Mitch McConnell of Kentucky.

Democrats countered that the bill merely reflects public opinion. Recent polls suggest that a majority of Americans think the ban on gays in the military should be overturned.

"We're going to fight for this," said Sen. Carl Levin, a Democrat from Michigan and chairman of the Armed Services Committee.

But at least for now, the question of how and when to change the policy returns to the Pentagon, which had set a December deadline to complete a study of the effects of lifting the ban. Defense Secretary Robert Gates has said that he supports President Obama's goal of repeal, but Gates made it clear he thought the process should move gradually.

It is not clear how quickly the Pentagon might make its own recommendations. Pentagon press secretary Geoff Morrell declined to comment yesterday on what he called "an internal procedural matter for the Senate."

Initially, advocates had thought that Democrats might win the 60 votes needed to overcome GOP objections and advance the bill. Sen. Susan Collins, a moderate Maine Republican, was seen as a crucial vote because she supports overturning the ban.

But Collins ultimately sided with her GOP colleagues in arguing that the bill shouldn't advance because Republicans weren't given sufficient chance to offer amendments to the wide-ranging policy bill.

Democrats also failed to keep all of their party members in line. Democratic Sens. Blanche Lincoln and Mark Pryor, both of Arkansas, voted with Republicans to scuttle the bill. The vote was 56-43, four short of the 60 required to advance under Senate rules. (next page »)

What about the health care bill, Democrats? Polls show that 2/3 of the population don't like that.

What about gay marriage? A majority of Americans do not agree with that.

What about cap and trade? A majority of Americans do not think that we should pass that legislation.

What about global warming? A majority of Americans do not believe in that?

What about extending all of the tax cuts? A majority of Americans believe that we should extend them.

What about immigration? A majority of Americans do not want the comprehensive immigration reform which the Democrats support and they do not like amnesty for illegals.

I am not even happy with "don't ask don't tell".......I support even stricter regulations....but I am glad to see this bill go down in defeat. Enough of the gay bulldozer movement.

which is amnesty for all the illegal alien law breakers, all 20 million of them, or path to citizenship as they call it. Probably trying to get more illegal votes for November.

I think it will be apparent fairly soon what you're made of: You want to take cheap personal shots and have no accountability for it. I'll hold you accountable. You don't even have the basis to call me a hypocrite...you just hurl insults. You've also called me a woman and said that I hate America. You've crossed the line with me. It will be apparent by your lack of response here to all...that you are a coward. I want all of your conservative supporters on this site to see that Millenia fears me and can't keep his word that he and I will no longer post to or about each other. Now obviously when he posts about me I'm going to say something to him. This thing ends when Millenia keeps up his end of the bargain. I think one of his conservative buddies on this site needs to advise him of the basic etiquette that when someone asks you to stop communicating with them or about them....you do it.

You are afraid of me. You don't have the courage of your convictions. You can not even abide by a simple agreement that neither of us post to or about each other. You are not to address me, or talk about me in any way, shape, or form. That was the agreement. You have not lived up to it. You made a reference to me as a hypocrite. When you write a post near mine, referring to me, calling me a name....it is not living up to the agreement. The purpose, in my view, of not communicating with each other, is that we do not end up in an escalating situation. You say you don't want any part of this but yet you insist on escalating the situation.

You need not worry or concern yourself about me; worry about yourself. My reaction has been pretty reasonable. You've called me a woman, you've told me I hate America, and now you've called me a hypocrite. I think you should imagine how just about anybody, any stranger, would react to you if you said those things to them in person. You'd expect a fight. You wouldn't say those things to someone in person if you didn't. Why should you expect any different reaction when you're on line?

A long time ago when we made our agreement, I gave you the opportunity to have the last word, you took it, but you've continued. Now...I will not let you have the last word. I will bet you that this is not what the Dream Act is. If you are correct, I will cease posting on this site forever. If I am correct...you will do the same.

Or do you want to take this opportunity to tell us what the Dream Act actually is?
