Ayotte calls Justice Kagan 'unqualified'

Former New Hampshire attorney general Kelly Ayotte said Elena Kagan is unqualified to serve on the U.S. Supreme Court.

The U.S. Senate on Thursday confirmed Kagan as the court's 112th justice. Ayotte said she would have voted against confirmation.

The Republican Ayotte said she's troubled by Kagan's efforts as Harvard Law School dean to bar military recruiters from the school because of the prohibition against openly gay soldiers.

Kagan has said she was merely complying with Harvard's nondiscrimination policy.

Kagan is a lawyer and academic with a reputation for brilliance and a liberal bent. She was President Obama's nominee to succeed retired Justice John Paul Stevens.

Ayotte is vying to succeed retiring Sen. Judd Gregg.
