Penacook man indicted on rape charge

A Penacook man accused of raping a 13-year-old in an abandoned home in the village last year was recently indicted by a grand jury.

Taylor “T.J.” Winter, 19, faces one count of felonious sexual assault in Merrimack County Superior Court in Concord, where a grand jury heard last month the evidence in the case against him.

Winter is accused of sexually assaulting a girl at a residence on Community Drive in Penacook on the night of Nov. 24, 2018, during an underage drinking party.

As part of the sexual assault investigation, the 13-year-old girl was interviewed at the Merrimack County Advocacy Center in early December. She said she and her friend had walked to 24 Summer St., on the night of Nov. 24, for a party where people they knew were drinking and smoking. They spent time with several teenagers at the house and then decided to go to a vacant apartment next door with two boys, including Winter, according to court documents.

The 13-year-old girl said that once inside the Community Drive residence Winter pushed her up against a wall next to the stove and started touching her inappropriately, according to a sworn police affidavit. She said he touched her without her consent and then led her downstairs to the basement where the sexual assault occurred.

Winter has pleaded not guilty to the charge.

A final pretrial hearing is scheduled for Jan. 22 with jury selection set for Feb. 4.
