A judge will dismiss the domestic violence case against a New Hampshire probation and parole officer in nine months as long he remains of good behavior.
Justin Evans, 31, faces alternative misdemeanor counts of false imprisonment, one of which is domestic violence-related. Defense attorney James Moir and City Prosecutor Tracy Connolly reached an agreement to resolve the case last week, which places the charges against Evans on file without finding for a period of nine months. The case will then be dismissed; however, the initial charges will remain on Evansโs record.
Evans indicated in a preliminary agreement filed Sept. 20 his desire to resolve the case without a bench trial as long as the disposition did not jeopardize his ability to maintain his law enforcement certification in the state.
โIf it is determined that the disposition will have no impact upon his certification, the parties will file an agreement regarding placing the matter on file without a finding,โ attorneys wrote. โIf counsel determines the answer is otherwise, he will file a request for a specially assigned trial date.โ
The New Hampshire Police Standards Training and Council voted, 6-5, at its May 22 meeting in favor of allowing Evans to maintain his law enforcement certification while the criminal case is pending.
Evans has been restricted to desk work and other administrative responsibilities since his arrest.
Police responded to a domestic disturbance call at a residence off Fisherville Road on the afternoon of April 7. Prosecutors allege Evans prevented his intimate partner and her son from leaving a garage by parking his vehicle directly behind hers at a home.
Evans was arrested on the misdemeanor charges and released on $4,000 personal recognizance. Certain bail conditions remained in effect until last week; the court has since vacated all prior bail orders in light of the resolution of the case.
