A Vermont man charged with threatening a police officer during a police-involved shooting in Hopkinton will be released on bail when he leaves the hospital, but will have to report to Vermont for additional charges, according to court documents.
Merrimack County Superior Court documents say Bryan Evans, 31, of Quechee, Vt., was released on $40,000 personal recognizance bail on May 26, but could be facing $50,000 cash bail in Vermont, according to Windsor County court documents. He is facing charges of receiving stolen property, unauthorized use of a propelled vehicle, criminal threatening and disobeying an officer in New Hampshire.
The charges stem from a May 19 shooting that occurred after Evans initially refused to pull over for police and, once he did pull over, allegedly told K-9 state police officer Daniel Livingstone that “if you release the dog, you’re a dead man,” or words to that effect and pointed his hands at police in a “gun style fashion,” according to court documents. Livingstone, along with state police Officer Michael Arteaga and New London police officer James MacKenna, then fired at Evans. Arteaga fired two shots, hitting Evans once in the leg, Livingstone’s handgun malfunctioned and did not fire, and MacKenna fired one shot from a rifle and missed, according to a report from the state attorney general’s office.
Evans was driving a 2017 Toyota Camry, which belonged to his mother, about 6:47 p.m. on May 19 on Interstate 89, “knowing that it had been stolen,” according to court documents. The shooting caused police to shut down the highway for several hours.
Evans’s personal recognizance will go into effect when he is released from Dartmouth-Hitchcock Medical Center, where he remains after undergoing surgery at Concord Hospital. However, part of his conditions stipulate that Evans must report in person to the Hartford, Vt., police department within 24 hours of being discharged from the hospital.
Evans is accused of burglary and larceny in Vermont after he allegedly broke a window at his mother’s home in Quechee, grabbing her keys and stealing her car, according to court records from Windsor County. Evans’s mother Laurie told police her son was a heroin addict and had been “trying to get himself right.” She said she told her son she didn’t want him in her residence anymore after driving him to the Lebanon Police Department. She said she suspected he had started using drugs again and stole the car to drive down to Boston to buy drugs, court documents say.
Vermont state attorney Ward Goodenough filed an emergency application for an arrest warrant May 24 as a result of the charges Evans faces in Vermont, according to Windsor court documents. It’s unclear at this time whether that request has been granted. Should Evans be able to post his bail – he initially bonded the $40,000 in New Hampshire on May 22, according to Merrimack County court documents – it is unclear where he would go.
According to Merrimack County court documents, Evans’s bail would require him to refrain from use of alcohol and controlled drugs, possessing a firearm and shall live at the Quechee, Vt., residence where his mother lives. However, in Vermont, prosecution is requesting, in addition to having Evans contact a drug abuse counselor, that Evans stay at least 300 feet from that same residence.
