A judge has ordered a Concord man accused of aiding two teenagers in carrying out an armed robbery in the city to undergo a mental health evaluation.

The evaluation will help the court determine whether Davein Jenkins, 46, is mentally competent to stand trial in Merrimack County Superior Court.

Jenkins is charged with accomplice to armed robbery, hindering apprehension, possession of Suboxone and endangering the welfare of a child in connection with an armed robbery at the Shell gas station on Loudon Road in Concord in October.

Defense attorney Robin Davis filed a motion with the court on March 29 to have Jenkins evaluated by a state forensic examiner and possibly by a licensed psychiatrist who would review the initial findings and conduct an independent assessment.

โ€œDefense counsel met with Mr. Jenkins and one of his case managers. It was determined that he had at least one head injury approximately 10 years ago and he is presently participating in programming with Riverbend,โ€ Davis wrote of the community mental health organization. โ€œGiven the circumstances, there is a very clear question regarding Mr. Jenkins competency to stand trial.โ€

Prosecutors allege Jenkins provided the 16-year-old with a piece of a Suboxone strip โ€œto calm him downโ€ and a change of clothes so the teen wouldnโ€™t be identified following an armed robbery of the gas station, according to a sworn affidavit prepared by Concord police Det. Wade Brown. Jenkins is also accused of cutting the orange tip off a black BB gun because the 16-year-old wanted it to look like a โ€œreal gunโ€ and not a โ€œfake gun,โ€ the affidavit says.

The teen and a 15-year-old friend robbed the gas station at 24 Loudon Road near Everett Arena on Oct. 21 at 12:22 a.m., police said. A store clerk reported that two young men had entered the gas station wearing bandanas or shirts duct taped over part of their faces. One approached the register and pointed a handgun at the clerk, while the second stayed by the door as โ€œan apparent lookout,โ€ police said.

The clerk told police she handed over about 30 packs of Marlboro Red cigarettes and the register drawer, which contained about $50 to $70, the affidavit says.

Because the suspects are under 18, any criminal charges against them will proceed in the juvenile court where case records are sealed.

Jenkins is out of jail on $10,000 personal recognizance. His bail conditions prohibit him from having contact with the teens or their family members.

A competency hearing is scheduled for June 28 at 10 a.m. in Concord.
