A Concord man who shattered a glass door to an occupied apartment, threw glass at police officers and spit in a firefighter’s face during a burglary in the city in June will be on probation for three years.
Irakoze Ildephonse, 29, was sentenced to jail time earlier this year and has served his sentence, which included credit for 194 days he was incarcerated pretrial, according to jail records. As part of a plea deal reached with county prosecutors, Ildephonse received several concurrent 11-month county jail sentences, in addition to a suspended 11-month sentence that will hang over his head for seven years. He was also ordered to complete a mental health evaluation and to follow through with any recommended treatment.
The plea deal was filed in Merrimack County Superior Court in Concord after a state forensic examiner found Ildephonse competent to stand trial.
He has since pleaded guilty to nine charges: two counts each of reckless conduct and criminal mischief, as well as one count each of criminal trespass, breach of bail, simple assault, disorderly conduct and resisting arrest.
At the time he committed the burglary and related offenses at 32 Cherry St., Ildephonse was out of jail on bail conditions in an unrelated case.
Police arrested Ildephonse at the multi-unit apartment complex at 32 Cherry St., on the afternoon of June 20, 2018. The 911 call came in about 2:55 p.m., reporting a burglary in progress. A mother and daughter had fled their apartment after Ildephonse, who was naked, climbed up to their second-floor balcony and smashed a glass storm door to gain entry into the residence.
When officers arrived they observed Ildephonse vandalizing the apartment and throwing items off the porch. They attempted to negotiate with Ildephonse from outside, without success. Instead, they said, he responded by throwing large pieces of glass at them, forcing them to retreat to a wooded area nearby to avoid injury, according to court documents.
With additional officers providing backup, authorities were able to protect other residencies and approach Ildephonse while he was still inside the apartment. He was subdued with a Taser, although he still struggled as officers tried to secure handcuffs on him.
Initially, police had charged Ildephonse with beating and attempting to strangle a golden retriever that lived at the residence, but the charge was dropped as part of the plea agreement.
Additional charges of breach of bail, simple assault and indecent exposure were also dismissed.
