A federal court magistrate judge has recommended the dismissal of all claims filed by an Oregon woman against Mayor Rick Becksted, alleging the city’s mask ordinance violates her rights despite her living on the other side of the country.
Huguette Nicole Young is representing herself in the lawsuit she filed Nov. 2, claiming the city’s mask mandate infringes on her First Amendment right to free speech “by literally blocking plaintiff’s ability to communicate audibly, clearly and expressively.”
Young, a former commercial truck driver, alleges she is “currently seeking new work opportunities in Portsmouth.” She currently lives in Eugene, Oregon, her complaint states, “but is eager to relocate anywhere opportunity takes her as long as there is no mask mandate.”ย
“The federal government has not issued face mask requirements in any jurisdiction, only state and local governments have done so,” Young wrote in her complaint. “However, many health experts and scientists in the federal government who know better are purposely skewing scientific data to make it appear COVID-19 is a public health disaster and to imply that requiring face masks is the best way to address the public health disaster.”ย
