The question of whether Seabrook can open its town-owned beach even though Gov. Chris Sununu ordered state beaches closed was answered at Thursday’s special selectmen’s meeting by a letter from the governor’s attorney.

“Any town independently flexing open their beach on their own will undoubtedly invite a huge influx of visitors from very infected areas on the North Shore and around Massachusetts,” wrote John Formella, Sununu’s legal counsel. “Therefore, although we do not currently have an emergency order in place closing all coastal beaches, Gov. Sununu would issue one should it become necessary to do so.”

The message is clear: If selectmen open Seabrook Beach, their action will be futile because Sununu will immediately issue a specific executive order closing it again.

Formella’s letter to Seabrook selectmen and state Rep. Aboul Khan came after a discussion at the May 4 selectmen’s meeting. Several Seabrook residents urged selectmen at that meeting to open Seabrook’s town-owned beach, despite Sununu’s executive order for beaches to remain closed through May 31.
